Terms and Conditions of Sale (T&Cs)

Welcome to JAMEL GEMS.
These Terms and Conditions of Sale (“T&Cs”) govern all sales of products by JAMEL GEMS via the website www.jamel-gems.com, remotely, or in person.
By placing an order, the customer acknowledges having read, understood, and unconditionally accepted these T&Cs.

 


 

1. Scope

These T&Cs apply to all sales of products and services offered by JAMEL GEMS, a sole proprietorship registered with the Annecy Trade and Companies Register under number 902 096 361, with headquarters at 129 Avenue de Genève, 74000 Annecy, France.

They apply to consumers (individuals buying for personal use) and professionals, unless specific written conditions have been agreed.

Any special written conditions agreed between JAMEL GEMS and the customer shall prevail over these T&Cs in case of conflict.

 


 

2. Products

JAMEL GEMS offers carefully selected gemstones and jewelry, described with details such as weight, size, color, clarity, and provenance when available.

Additional information can be provided upon request via email or message.
Photos and descriptions are for informational purposes only and do not constitute a contractual offer.

 


 

3. Pricing

Prices for products available online are displayed directly on the website. For certain products, prices may be provided upon request via email.

Prices are subject to product availability and market fluctuations.

Any price communicated (by email, message, or website) is indicative only and does not constitute a binding offer for sale.
The price becomes final and contractual only after written confirmation by JAMEL GEMS on the issued invoice.

Products remain the property of JAMEL GEMS until full payment of the price indicated on the invoice.

 


 

4. Orders

Orders may be placed online or directly with JAMEL GEMS. A sale is considered concluded only after:
  1. Order confirmation by JAMEL GEMS, and

  2. Full payment of the agreed price is received.

Hand delivery occurs by appointment in Annecy (France) or another mutually agreed location.

For customers outside mainland France, a customized appointment can be arranged, with advance payment covering related costs (transport, accommodation, logistics).

 


 

5. Payment Terms

 

5.1 Hand Delivery

  • Payment must be made in full by bank transfer prior to the scheduled appointment.

  • The product will only be delivered after full payment has been received.

  • No product may be reserved or delivered before payment confirmation in JAMEL GEMS’ bank account.

  • The invoice issued by JAMEL GEMS is the only official document validating the price and payment.

5.2 Online Orders

  • Payment for online orders must be made in full at the time of order, using the methods provided on the website (bank transfer, secure online payment, etc.).

  • The order is considered confirmed only after receipt and full clearance of payment.

  • Products will only be shipped after full payment is received.

  • The invoice issued by JAMEL GEMS is the only official document validating the price and payment.

     


 

6. Deposits and Cancellations (Appointments Requiring Travel)

For appointments requiring travel (within France or internationally), a deposit is required to cover related expenses.

  • Deposits are non-refundable, except in cases of cancellation by JAMEL GEMS or force majeure.

  • If the customer cancels for a valid reason (emergency, unforeseen event), the deposit may be applied to a future appointment, provided that incurred costs (flight tickets, hotel, etc.) can be canceled.

  • If JAMEL GEMS cancels, the customer may receive a full refund of the deposit or reschedule the appointment at their convenience.

     


 

7. Delivery and Transfer of Risk

Products are delivered either in person (hand delivery) or by secure postal shipping for online orders.
During hand delivery, the customer may conduct a visual inspection of the products.

Ownership of products is transferred to the customer only after full payment.
Risk of loss, theft, or damage transfers to the customer upon delivery.

 


 

8. Right of Withdrawal (Online Orders Only)

In accordance with applicable law, the customer has a 14-day legal right of withdrawal from receipt of the product, only for online purchases.

Conditions:

  • The product must be returned unused, in perfect condition, in its original packaging, and accompanied by the purchase invoice.

  • Return shipping costs are covered by JAMEL GEMS, provided the customer requests it in advance and uses the return form.

Exclusion: Sales concluded in person (hand delivery) are final and not subject to withdrawal.

 


 

9. VAT and Taxes

VAT is not applicable, Article 293 B of the French General Tax Code.

For customers outside the European Union, customs duties or local taxes may apply and are the responsibility of the customer.

 


 

10. Liability

JAMEL GEMS guarantees that all products comply with French legal standards.

JAMEL GEMS shall not be liable for:

  • Improper use, poor maintenance, or modification of the product after delivery,

  • Consequences of exporting the product to a country where it does not comply with local law.

     


 

11. Intellectual Property

All content on www.jamel-gems.com (texts, images, logos, trademarks, etc.) is protected by intellectual property rights and remains the exclusive property of JAMEL GEMS.

Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

 


 

12. Personal Data Protection

JAMEL GEMS collects and processes personal data solely for order management and customer relations.

Data is processed in accordance with the EU General Data Protection Regulation (GDPR) 2016/679.
Customers have the right to access, correct, and delete their data by contacting: jamelgems@gmail.com.

 


 

13. Governing Law and Jurisdiction

These T&Cs are governed by French law.

In case of dispute, parties will seek an amicable solution. Failing that, the Commercial Court of Annecy (France) shall have exclusive jurisdiction.

 


Final Provisions

If any provision of these T&Cs is declared null or unenforceable, the remaining provisions shall remain fully in effect.

By placing an order, the customer acknowledges having read and accepted these T&Cs.
